The applicant's agent, Ms Emin, explained that the premises had operated without issues for the past three years. She highlighted that the Police and other responsible authorities had not raised any objections. Ms Emin addressed the Objector's concerns by stating that the premises had been closed for three months for refurbishment and that the new operational model would be as a bistro and restaurant, not solely a bar. She also suggested that the Objector's flat was not in close proximity to the premises and that most seating would face the road, minimising noise to the rear.

The Objector, however, maintained concerns about noise from late-night alcohol consumption, deliveries, and refuse disposal at the rear of the premises. They also raised issues regarding potential anti-social behaviour, such as public urination, and past incidents of disorder in the vicinity.

The Licensing Panel carefully considered all representations, the Licensing Act 2003, the Statutory Guidance issued under section 182 of the Act, and the London Borough of Harrow Statement of Licensing Policy.

Decision: The Panel decided to GRANT the application with amended and new licence conditions.

The approved hours for the sale of alcohol are:

  • Monday to Thursday: 10:00 to 01:00 (the following day)
  • Friday and Saturday: 10:00 to 02:00 (the following day)

New and Amended Licence Conditions: To address the Objector's concerns and promote the licensing objectives, the Panel imposed the following conditions:

  • An incident/refusal log will now include any incidents of disorder.
  • Sales of alcohol for consumption off the premises will only be supplied with, and ancillary to, a take-away meal.
  • No rubbish, including bottles, shall be moved, removed, or placed in outside areas between 23:00 and 08:00.
  • No glass waste, including bottles, shall be handled externally after 23:00, except for the collection of empty glasses from outside areas and nearby streets.
  • No pre-arranged deliveries or unloading of goods are permitted between 23:00 and 08:00.
  • Outside tables and chairs are not to be used by customers after 23:00 each day.
  • A direct telephone number for the manager will be publicly available at all times the premises is open and provided to residents in the vicinity.

The Panel also reminded the applicant that breaches of the licence conditions could lead to a review of the licence or its revocation.

The meeting was chaired by Councillor Ramji Chauhan. The other councillors present were Councillor Chetna Halai and Councillor Eden Kulig. The meeting concluded at 7:10 pm.
