The sub-committee was scheduled to review an application from Intracave Limited for a variation of an existing premises licence for the KFC located at Unit 3, Sprotbrough Road, Sprotbrough, Doncaster, DN5 8BN.

The application sought to extend the hours for late-night refreshment from the current 11:00 PM - 11:30 PM to 11:00 PM - 2:00 AM, Monday to Sunday. According to the report pack, the current premises licence permits late-night refreshment until 11:30 PM.

According to the report, a relevant representation was received from a responsible authority, relating to one or more of the four licensing objectives¹. The representation was made by Fiona Boothroyd, Senior Environmental Health Practitioner, who raised an objection on the grounds of potential public nuisance:

Thank you for consulting with the Environmental Health Team about this application to extend KFC’s late-night opening hours from 23:30 to 02:00. I must raise an objection to the proposed on the grounds for the potential for public nuisance, because of the close residential properties located to the right and opposite the premises.

The likelihood of people sitting in their cars after purchasing their food, playing music, talking in the carpark and the noise associated with drive thru operations at a time when most people are in bed, increases the potential for incidences of noise nuisance disturbing sleep to occur.

The control of customers behaviour while in the public carpark would be beyond the business’s scope and signage, whilst good practice, would have no practical effect if ignored by the clientele.

The report pack outlined that the sub-committee could modify the conditions of the licence or reject the whole or part of the application.

Review of Existing Licences

The sub-committee was also scheduled to review several existing licences. These reviews were to be conducted in private session due to the confidential nature of the information to be discussed, as they related to information about individuals.
