The approval includes the use of the Council's powers under Section 203 of the Housing and Planning Act 20161 to override easements and other third-party rights that may be infringed by the development. Authority has also been delegated to the Delivery Director to make payments of compensation for any genuine claims of affected third-party rights. The contract with Contractor A includes a break clause, contingent on planning submission and approval for the seven-home scheme. The council also noted that entering into the JCT Design & Build 2016 contract is subject to planning permission being granted.

The report highlighted the scheme's contribution to strategic outcomes, supporting the delivery of high-quality, sustainable, and affordable homes. The scheme will also be re-evaluated for overheating risk in line with Building Regulations Part O.
