Conditions: The licence was granted subject to a number of conditions, including:
- Display of CCTV signage.
- Installation and maintenance of a comprehensive CCTV system.
- A staff member conversant with the CCTV system to be present at all times.
- Regular staff training in the Licensing Act 2003.
- Maintenance of an incident log.
- Display of notices requesting patrons to respect local residents.
- Operation of a Challenge 25 scheme1.
- No removal of alcoholic drinks in open containers from the premises.
- No alcohol to be supplied if the CCTV equipment is inoperative.
- Placement of extra litter bins and regular cleaning of the outside area.
The panel considered concerns raised by objectors, primarily relating to public nuisance and crime and disorder. These concerns included the potential for the premises to operate like a pub, excessive opening and licensing hours for a park in a residential area, and the impact on anti-social behaviour and littering.
The applicant, represented by Mr Lynn, clarified that they intended to operate as a café and sought longer hours to align with events at Gunnersbury Museum. The applicant expressed flexibility regarding licensing hours and committed to ceasing alcohol service an hour before closing.
The panel considered a later licensing start time of 12:00pm and an earlier termination time of 10:00pm appropriate to ensure the licensing objectives of the prevention of crime and disorder and the prevention of public nuisance.
The panel also addressed concerns about litter, noting that the licence was for on-sales of alcohol only, preventing customers from purchasing alcohol for off-premises consumption. A condition was included to ensure the premises did not contribute to litter issues, requiring regular checks and cleaning of the outside area.
The panel did not retain a proposed condition regarding loud music,
as the applicant stated they only intended to play background music. Similarly, a condition about closing outside seating areas at specific times was not retained, as the applicant's proposed opening hours would naturally result in earlier closure of external areas.
The decision to grant the licence with the specified hours and conditions was made after considering all relevant information, including written and oral representations, the Licensing Act 2003, statutory guidance, Hounslow Council’s Statement of Licensing Policy 2020-20252, and the Human Rights Act 1998.
Monitoring Officer Note on Interests
The Licensing Panel approved the recommendations outlined in the Monitoring Officer's note on interests. The note, which references the Members’ Code of Conduct, reminds members to declare any personal or pecuniary interests in matters being discussed, and to recuse themselves from discussions or votes where such interests exist. It also provides guidance on predetermination and bias, advising members to approach decisions with an open mind.
