Summary

Request for Refusal of Landlord Registration for Elio Carpico
The committee was scheduled to consider a request to refuse the landlord registration application of Elio Carpico. According to the report, local authorities must consider whether a landlord is a 'fit and proper person' before adding them to the register, as required by the Antisocial Behaviour etc. (Scotland) Act 20041. This involves considering any breaches of housing or tenant law, as well as any offences involving fraud, dishonesty, violence, drugs, discrimination, or firearms.
The report notes that Elio Carpico declared a conviction dated 23 March 2010 on his application form. However, a letter from Police Scotland mentioned a different conviction from 14 October 2024, which Elio Carpico did not declare. The committee was asked to consider refusing the application based on the convictions, and Elio Carpico was invited to attend the meeting.
Variation to HMO Licence - 1 Abbey Lane
The committee was scheduled to review applications to vary existing HMO licences for properties at 1 Abbey Lane. The applicant, LDC (Portfolio) Ltd, requested an exemption from the council's policy to remove conditions that excluded certain rooms from the licences. These rooms reportedly did not meet the standards outlined in the statutory guidance on HMOs for Licensing Authorities. The committee was asked to consider the request, taking into account the suitability of the living accommodation, its location, condition, amenities, the number of occupants, and public safety.

Request for Fee Refund – Public Entertainment Licence – Centre for Sustainable Practice in the Arts
The committee was scheduled to consider a request for a fee refund from the Centre for Sustainable Practice in the Arts (CSPA) for a temporary public entertainment licence. The CSPA had been granted a licence for the Climate Change Theatre Action event at Harry Younger Hall, 3 Lochend Cl, between 1 and 24 August 2025.
The report noted that licence application fees are calculated to cover the cost of the licensing system, and that the Climate Change Theatre Action event was operated as a commercial event with fees charged for public attendance. It also noted that the council approved a policy of full cost recovery for major events delivered by third parties in February 2019, increasing cost recovery through charges levied for licensing and regulatory services, road occupation licences, and consents. The committee was asked to note that granting a fee refund risks setting a precedent.
