Mario's Pizza, 133 Salmon Lane, London E14 7PG
The committee considered an application to extend the hours for the provision of late-night refreshment at Mario's Pizza. The original application sought to extend hours to 4:00 AM seven days a week, significantly beyond the current licence hours and the council's framework hours. Environmental Health objected due to concerns about public nuisance, citing the proximity of residential properties and the potential for increased noise from patrons and delivery drivers during the extended hours. Residents also raised objections regarding noise from an extractor fan, odours, and potential anti-social behaviour.
The applicant, Abdullah Sahil, stated that the premises operates solely as a takeaway and delivery service, with no indoor seating and no music or entertainment. He argued that deliveries would be handled quietly and that extending hours would align with local trading patterns. However, the Licensing Authority noted a history of breaches of licensable hours, including failed test purchases in 2024, indicating a disregard for current regulations.
The committee decided to refuse the application. The decision was based on the significant extension of hours sought, the proximity to residential properties, and the applicant's history of breaching licensable hours, which raised concerns about the promotion of the licensing objective of preventing public nuisance.
Milano Express Pizza and Peri Peri, 479 Cambridge Heath Road, London E2 9BU
The committee considered an application to extend the hours for late-night refreshments at Milano Express Pizza and Peri Peri. The applicant, Abdul Wadood Mangal, initially sought to extend hours to 4:00 AM Sunday to Thursday and 5:00 AM on Fridays and Saturdays. Environmental Health objected, citing concerns about public nuisance due to noise and the impact of late-night operations on nearby residents.
Following discussions, the applicant amended the application, reducing the requested hours to 3:00 AM Sunday to Thursday and 4:00 AM on Fridays and Saturdays. Crucially, the applicant committed to operating as a delivery-only service after 1:00 AM, with no customers permitted on the premises. They also stated that deliveries would be conducted by directly employed drivers, with a noise management plan and enforceable licence conditions to control driver behaviour and prevent congregation.
The committee granted the variation with modifications. The hours for late-night refreshment were extended to 3:00 AM Sunday to Thursday and 4:00 AM Friday and Saturday, with the condition that after 1:00 AM, the premises would operate on a delivery-only basis. This decision aimed to balance the applicant's desire for extended trading hours with the need to mitigate potential public nuisance.
The Widow's Son, 75 Devon's Road, London E3 3PJ
The committee considered an application to vary the premises licence for The Widow's Son, which included extending alcohol sales hours, extending late-night refreshment hours, and incorporating an external seating area into the licensed premises. The application had been previously adjourned to allow the applicant to provide updated plans.
Representations were received from residents, Environmental Protection, and the Licensing Authority. Residents raised concerns about noise, public nuisance, crime and disorder, and public safety, citing a history of breaches of existing licence conditions regarding outdoor capacity and noise. Environmental Protection objected due to the potential for noise disturbance and public nuisance from patrons accessing and egressing the premises during the proposed extended hours, particularly with the inclusion of an external seating area. The Licensing Authority also objected, highlighting previous complaints and breaches of licence conditions, and questioning the applicant's ability to manage the premises responsibly, especially with extended hours and an outdoor area.
During the hearing, it was clarified that the external area in question is private land belonging to a nearby residential development. The applicant indicated a willingness to adjust the dimensions and location of the proposed outdoor seating area.
The committee decided to adjourn the decision on this application to allow for further clarification regarding the plans for the external seating area and to consider the implications of the land ownership.
Other Business
The committee also agreed to extend the decision deadlines for two applications: the Road Street Club for New Drum Street, London E1, and Amazon at 100 Dunbridge Road, London E2. These extensions were agreed until 30 April 2026.
