Summary
Open Council Network is an independent organisation. We report on Barnet and are not the council. About us
The Constitution Committee of Barnet Council was scheduled to discuss the entirety of the council's constitution. This comprehensive document outlines the framework within which the council operates, detailing how decisions are made, the procedures to be followed, and the roles and responsibilities of councillors, officers, and various committees. The meeting's agenda was structured to cover all parts of the constitution, from its fundamental articles and procedural rules to specific codes of conduct and financial regulations.
The Constitution
The meeting was scheduled to review the council's constitution, a document that establishes the operational parameters for the London Borough of Barnet Council. The constitution is designed to ensure the council functions efficiently, transparently, and accountably to its residents. It details the legal and procedural requirements that govern the council's activities, as well as local choices the council has made regarding its governance.
The constitution is divided into several key parts:
- Part 1 - The Articles: These articles lay out the fundamental provisions of the constitution, including the council's powers, its purpose, and how the constitution itself is interpreted, reviewed, and amended.
- Part 2 - Allocation of Responsibilities: This section details the terms of reference for various council bodies, including the Full Council, committees, sub-committees, the Cabinet, and Cabinet Members. It also outlines delegations to officers and functions that are not the responsibility of the Executive.
- Part 3 - Rules of Procedure: This part covers the procedural rules for various council meetings, including those for the Full Council, the Executive, committees, and the process for accessing information. It also includes rules for budget and policy development, and a petition scheme.
- Part 4 - Regulations, Rules and Codes: This section contains a range of regulations, rules, and codes that govern the council's operations, such as Financial Regulations, Contract Procedure Rules, HR Regulations, Codes of Conduct for Members and Officers, and the Code of Corporate Governance.
The agenda items reflected a systematic review of each of these parts, indicating a thorough examination of the council's governance framework. This included detailed discussions on the roles of the Mayor, the Executive, and officers, as well as the procedures for decision-making, financial management, contract awards, and member conduct. The meeting was also set to cover the council's approach to publicity, members' rights to access information, and the social media code of conduct.
