Open Council Network is an independent organisation. We report on Haringey and are not the council. About us

The Licensing Sub Committee was scheduled to consider two applications for premises licences. One application was for a variation to extend the operating hours of a KFC restaurant, and the other was for a new premises licence for a Nisa convenience store.

Application for Variation of Premises Licence at KFC, Tottenham

The committee was scheduled to consider an application from FT FOODS LTD to vary the premises licence for KFC at 479-481 High Road, Tottenham, London, N17 6QA. The application sought to extend the hours for late-night refreshment from 23:00 to 04:00 every day, and to amend the opening hours to 10:00 to 04:00 every day.

The report pack indicated that the premises is located on a busy High Road with several late-evening food establishments and associated issues of anti-social behaviour and street drinking. Representations were outstanding from the Metropolitan Police and a similar business, Dixy Chicken, raising concerns about the prevention of crime and disorder.

The Metropolitan Police's representation highlighted concerns about the proposed 04:00 terminal hour, noting that the area is already known for issues relating to drug dealing and anti-social behaviour. They stated that an increase in hours could risk an increase in such issues, particularly during the early morning. The police also expressed concern that the proposed condition regarding door staff was inadequate, as it is vague, subjective, and unenforceable. 1

A representation from Dixy Chicken also objected to the extension, citing the number of similar businesses already operating during those hours and the potential for increased public nuisance, loitering, crime and disorder, and noise pollution. They also suggested that FT FOODS LTD should be investigated for any past issues with other locations.

The report pack outlined the steps the Sub-Committee could take, including granting the application as requested, granting it with additional conditions, excluding licensable activities, or rejecting the application. It was noted that any decision must be appropriate for the promotion of the licensing objectives: the prevention of public nuisance, prevention of crime and disorder, public safety, and protection of children from harm.

Application for a New Premises Licence at Nisa, Broadwater Farm

The committee was also scheduled to consider an application for a new premises licence for Nisa at the Moselle Retail Unit, Broadwater Farm, Tottenham, London, N17 6HE. The application sought permission for the sale of alcohol for consumption off the premises between 07:00 and 23:00, Monday to Sunday, with the premises also open to the public during these hours.

The premises is located within the Broadwater Farm Estate, a fully residential area. A representation from Haringey Public Health was noted as outstanding.

Haringey Public Health's representation raised concerns regarding public safety and the protection of children from harm. They highlighted that the area is ranked in the top 7% most deprived nationally and has significant rates of alcohol-related harm. The representation noted the proximity of numerous schools, sheltered housing, care homes, and Haringey's drug and alcohol misuse service, The Grove, to the proposed premises. Public Health requested that the committee consider reducing the overall opening hours of the premises to 09:00–23:00, or restricting alcohol sales specifically to these hours.

The Metropolitan Police stated that they agreed with the requested timings for the sale of alcohol and the hours the premises would be open to the public. However, they requested that specific conditions be added to the operating schedule concerning CCTV, staff training, the placement of spirits behind the counter, keeping emergency exits clear, litter control, and the display of notices requesting customers to leave quietly. They also requested that delivery drivers be given clear instructions to operate responsibly. The police also proposed conditions related to the 'Challenge 25' proof of age scheme and the maintenance of a refusals register. The applicant agreed to most of these proposed conditions, with some minor amendments.

  1. The Licensing Act 2003 sets out the framework for regulating the sale of alcohol and other licensable activities. The four licensing objectives are central to the decision-making process for licensing authorities.
