Purpose

The contract between LBBD and
BD Group (also known as Barking and Dagenham Trading Partnership
Ltd Co (BDTP)) was originally entered into in 2018 and has been
subjected to several extensions.
 
The Cabinet will be asked to
agree arrangements, as part of the Council’s
‘Reset’ programme for Council-owned companies, relating
to the renegotiation of the contract between the Council and BD
Group that meets the current and future needs and requirements of
both parties.

Content

Cabinet resolved to:
 
(i)  Agree the entering
into of a new five-year contract with Barking and Dagenham Trading
Partnership Limited commencing 1 April 2026, for the provision of
housing repairs and maintenance via BDMS Ltd and cleaning and
catering services via BDCC Ltd, as detailed in the report;
 
(ii)  Agree that the
Council pay BDMS Ltd and BDCC Ltd the service costs/charges
quarterly in advance to support with management of their financial
liquidity, subject to compliance with the Subsidy Control Act
2022;
 
(iii)  Note the draft heads of
terms for the housing repairs and maintenance contract, as set out
at Appendix A to the report, and that specialist housing law
advisers shall be commissioned to support its development and
implementation; and
 
(iv)  Delegate authority to the
Strategic Director, Housing, Environment and Communities, in
consultation with the Strategic Director, Resources and the Head of
Legal, to conclude the negotiations with BDTP and finalise and
enter into the new contracts and all other necessary or
ancillary agreements to fully implement and effect the
proposals.
