Purpose

To set out the proposal to transfer the role of accountable body from Leicestershire County Council to EMCCA and in seeking approval for the transfer, provides an overview on the changes required to EMF’s governance documents and implications for DCC as a director of the Freeport.
 

Decision

RESOLVED to:

1)              Approve the role of Accountable Body for the East Midlands

Freeport (EMF) should transfer from Leicestershire County Council (LCC) to East Midlands Combined County Authority (EMCCA);

2)              Agree to the East Midlands Combined County Authority becoming a Founding Member of EMF;

3)              Approve the revised Members’ Agreement and Articles of Association at Appendix 3 and Appendix 4 of this report;

4)              Delegate authority to the Director of Legal and Democratic Services to make any minor amendments to the Articles of Association and Members Agreement;

5)              Agree to amend the previous approval to nominate Cllr Furniss and instead nominates the Cabinet Member for Finance and Efficiency as the East Midlands Freeport Company Director on behalf of Derbyshire County Council; and

6)              Note that the Council’s Cabinet Member Finance and Efficiency will have the power under the Articles of Association to appoint an Alternate to attend a Board meeting in their absence.
