Decision

The Sub-Committee considered the application to review the premises licence and AGREED to modify the conditions on the premises licence and add the following conditions:

1. All amplified sound at the premises shall be routed through a noise limiting device installed by the premises management. The device will be calibrated and the maximum sound level set by the Council’s Air Quality & Environmental Protection Service and confirmed in writing. The noise limiter shall be kept in a locked, tamper proof box and thereafter maintained for the duration of use of the premises.

Section 177A does not apply to the condition. This condition is added in accordance with Section 177A (4) of the Licensing Act 2003.

The Committee agreed the following recommendations:

• That the premises licence holder (PLH) organises a meeting with those who made representations to discuss the conditions that have been imposed. The PLH will offer the premises manager’s phone number so that the residents can contact if there are issues.

• That the Council’s Air Quality & Environmental Protection Service make regular visits to the premises to ensure compliance with the conditions.

• The Committee notes that the noise limiter would not be able to limit the level of noise from the drum and would respectfully recommend that there is no drum playing after 11p.m

The Sub-Committee determined this decision to be appropriate to uphold the licensing objectives

In accordance with the provisions contained within Schedule 5 to the Licensing Act 2003, the relevant parties have the right of appeal against the decision of the Sub-Committee to Thames Magistrates Court, 58 Bow Road, London E3 4DJ, such an appeal to be made within twenty-one days of notification of this decision.

A written letter outlining the decision and reasons will be sent to all parties within 5 working days.
