The New and Old Malden Neighbourhood Committee met on Tuesday 27 October 2026. The committee considered two planning applications.
26 Westbury Road, New Malden, KT3 5BE
The committee refused the application for a single-storey rear extension at 26 Westbury Road. The refusal was based on concerns regarding the potential for increased anti-social behaviour, unacceptable harm to neighbouring living conditions, and unresolved inconsistencies in the submitted daylight and sunlight assessments. Councillors also cited concerns about the accuracy of the application's drawings and the potential for the extension to facilitate a more intensive use of the premises. The refusal was based on the proposed rear extension, by enlarging the communal kitchen accommodation and introducing a flat roof, facilitating a more intensive use of the premises. Having regard to the evidence of reoccurring antisocial behaviour and disturbances associated with the existing use, that intensification would be likely to exacerbate neighbouring residents' reasonable founded fear of crime and cause unacceptable harm to their living conditions and enjoyment of their homes, contrary to Policy DM10 of the Royal Borough of Kingston upon Thames Core Strategy 2012 and Policy D3 of the London Plan 2021. Furthermore, the applicant failed to demonstrate that the proposed rear extension would preserve acceptable sunlight to the closest ground floor habitable room windows at number 24, Westbury Road, as the submitted assessment contained unresolved inconsistencies concerning site orientation and had not satisfactorily established the sunlight modelling uses the correct orientation. Consequently, the proposal was contrary to Policy DM10 of the Royal Borough of Kingston upon Thames Core Strategy 2012 and Policy D3 of the London Plan 2021.
223 South Lane, New Malden, KT3 5EW
The committee approved the application to change the use of 223 South Lane from a six-person House in Multiple Occupation (HMO) to an eight-person HMO. The decision was made subject to conditions, including limiting the occupancy to eight residents, ensuring the retention of communal facilities, and securing adequate cycle and refuse storage. Councillors noted the property's existing HMO status and the modest increase in occupancy. Conditions were also imposed to ensure the property adheres to HMO licensing standards and fire safety regulations.
