The proposed entrance encroaches upon City Fund land. The developer, DWS GRUNDSBESITZ GMBH, requested terms for occupying this land before construction commences.

According to the report pack, the land in question is not public highway and will not impact the public highway. It was acquired by the City in 1957 under the Metropolitan Paving Act 1817² for highway purposes. The City's Public Access Map initially classified the land as a Permissive Path, but this was later confirmed to be an error.

The report pack stated that declaring the land surplus would allow the City Corporation to proceed with its disposal, with the City Surveyor approving the terms under Delegated Authority. The report pack recommended that the committee resolve to declare the parcel of land surplus to highway requirements to facilitate its disposal.

The existing entrance is being extended by 1.34 metres and will feature a glazed perimeter wall with a revolving door projecting outward, approximately 1 metre in radius.
